KS Judges Practiced His Own Rule of Law When it Comes to Planned Parenthood

This Monday, a Johnson County, KS Grand Jury finished its investigation of the Planned Parenthood Overland Park clinic without issuing any indictments.

The Grand Jury previously issued a subpoena on January 7th for the medical records of 16 women who had abortions in 2003 to find out if Planned Parenthood correctly followed the 24 hour waiting law and parental consent law in Kansas before performing abortions.

However, Planned Parenthood refused to turn over the records, which should have resulted in contempt of court. But not in Judge Kevin Moriarty’s courtroom. No, Judge Moriarty allowed Planned Parenthood to delay. On Friday, February 29th, Judge Moriarty agreed to allow Planned Parenthood to turn over the medical records to him and only give the Grand Jury a spreadsheet created with what Planned Parenthood considered “pertinent information.”

The next business day, Monday, the Grand Jury said it had reviewed all the information and would not issue any indictments. At that time the Grand Jury had only met for 15 days out of the allotted 90. Fifteen days was not enough time to investigate Planned Parenthood, especially since the Jury never received the medical records that were subpoenaed.

Because of the Judge’s delay and inactivity, he failed what he and court were commissioned to do by citizens of Johnson County to investigate Comprehensive Health of Planned Parenthood of Kansas and Mid-Missouri for possible criminal activity.

Judge Moriarity should have recused himself from this case as he has invoked the “Moriarty Rule of Law,” which goes further than the typical liberal judicial activism.
